The biggest issue I have with threads regarding Orochimaru is that we've never seen him going all pasado without some sort of handicap. He was toying with the third to torment him, lost his jutsu and was essentially dying the first time we saw the deadlock, and when he fought a rampaging Naruto, his body was expiring, he still didn't have his jutsu, and he was merely there to test Naruto's strength.
Not to mention that he still has to go through his defensive layer of solidified sand, which was strong enough to withstand several blows from Lee (Eight Gates), but probably won't even reach to touch his body ... To sum it up, it would be like when Magneto beat Wolverine, but Crocodile is better off for being 100% sand in its simple form. I insist, it is a tie. xD
